Welcome to Confix. These Terms of Service ("Terms") govern your access to and use of the Confix website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

Please read these Terms carefully before using our Service. If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" and "your" will refer to both you individually and to that organization.

For the purposes of these Terms:

• "Service" refers to the Confix website, web application, and all related services, including our AI-powered landing page analysis tools.
• "User" or "you" refers to any individual or entity that accesses or uses the Service.
• "Account" refers to a registered user account on the Service.
• "Content" refers to any text, images, screenshots, data, or other materials uploaded, submitted, or transmitted through the Service.
• "Analysis" refers to the AI-generated feedback, recommendations, scores, and reports provided by the Service.
• "Credits" refers to the units used to access analysis features, allocated based on your subscription plan.
• "Subscription" refers to your paid plan (Free, Pro, or Max) that determines your access level and credit allocation.

3.1 Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

3.2 Account Creation

To access certain features of the Service, you must create an Account. When creating an Account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your Account information
• Maintain the security of your password and Account
• Accept responsibility for all activities that occur under your Account
• Notify us immediately of any unauthorized use of your Account

3.3 Account Security

You are responsible for safeguarding your password and for any activities or actions under your Account. We encourage you to use a strong, unique password. Confix will not be liable for any loss or damage arising from your failure to maintain the security of your Account credentials.

4.1 Overview

Confix provides an AI-powered landing page analysis service. Users can upload screenshots of their landing pages and receive automated feedback including:

• Overall score and design era classification
• Visual design, layout, typography, and conversion assessments
• Prioritized improvement suggestions
• Actionable implementation recommendations

4.2 Credit System

The Service operates on a credit-based system:

• Free Plan: 5 analyses per month
• Pro Plan: 50 analyses per month
• Max Plan: 500 analyses per month

Credits reset at the beginning of each billing cycle. Unused credits do not roll over to the next period.

4.3 AI-Generated Content Disclaimer

The analyses and recommendations provided by Confix are generated by artificial intelligence. While we strive for accuracy and helpfulness, AI-generated content:

• Should not be considered professional design or business advice
• May contain errors or inaccuracies
• Should be reviewed and validated before implementation
• Does not guarantee improved conversion rates or business outcomes

4.4 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. This includes changes to features, credit allocations, and pricing. We will make reasonable efforts to notify users of material changes.

5.1 Pricing

Current pricing for paid plans is available on our pricing page. Prices are subject to change with notice.

5.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis, depending on your selected plan. Payment is processed through our third-party payment processor. By subscribing to a paid plan, you authorize us to charge your provided payment method.

5.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage your subscription and cancel auto-renewal through your Account settings.

5.4 Refund Policy

To request a refund, contact us at support@confix.dev with your account email and reason for the refund request.

5.5 Cancellation

You may cancel your subscription at any time through your Account settings. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• You will retain access to paid features until the subscription expires
• Your account will revert to the Free plan after expiration
• Analysis history retention will follow Free plan limits after downgrade

5.6 Taxes

Prices may be exclusive of applicable taxes. You are responsible for paying any taxes associated with your use of the Service, except for taxes based on our net income.

6.1 Permitted Use

The Service is intended for analyzing landing pages for legitimate business purposes. You may use the Service to:

• Analyze your own landing pages or websites
• Analyze landing pages you have authorization to evaluate
• Export and share analysis results for business purposes

6.2 Prohibited Activities

You agree not to:

• Use the Service for any unlawful purpose or in violation of any laws
• Upload content that infringes on intellectual property rights
• Upload malicious, harmful, or inappropriate content
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Use automated systems or bots to access the Service without permission
• Resell, sublicense, or redistribute the Service without authorization
• Circumvent any rate limits or usage restrictions
• Create multiple accounts to abuse free credits or promotions
• Upload content containing personal information of others without consent
• Use the Service to harass, defame, or harm others

6.3 Content Guidelines

You are solely responsible for the content you upload. Content must not contain:

• Illegal material or content promoting illegal activities
• Malware, viruses, or harmful code
• Adult, explicit, or pornographic content
• Hate speech, discrimination, or content promoting violence
• Personal or confidential information of third parties

6.4 Enforcement

We reserve the right to investigate and take appropriate action against any violations of this policy, including removing content, suspending or terminating accounts, and reporting to law enforcement authorities when appropriate.

7.1 Confix Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Confix. This includes:

• Our AI models and analysis algorithms
• Website design, graphics, and user interface
• Trademarks, logos, and branding
• Documentation and marketing materials
• Software code and technical infrastructure

The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written consent.

7.2 Your Content

You retain ownership of any Content you upload to the Service. By uploading Content, you grant us a limited, non-exclusive, royalty-free license to:

• Process and analyze your Content to provide the Service
• Store your Content for your access and history features
• Create derivative works (analysis reports) based on your Content

This license terminates when you delete your Content or Account, except for any backups or copies required by law.

7.3 Analysis Results

The analysis reports, scores, and recommendations generated by the Service based on your Content are provided to you for your use. You may:

• Use analysis results for personal and commercial purposes
• Share results with clients, team members, or stakeholders
• Export and incorporate results into your own materials

7.4 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation to you.

Your privacy is important to us. Our collection, use, and sharing of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to the collection and use of information as described in our Privacy Policy. Key points include:

• We collect account information, usage data, and uploaded content
• Uploaded screenshots are processed by AI and stored securely
• We do not sell your personal information to third parties
• You can request deletion of your data by deleting your account

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• The quality of the Service will meet your expectations
• Any errors in the Service will be corrected

AI-generated recommendations are not professional advice. Implementation of suggestions is at your own risk. Results may vary and are not guaranteed.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CONFIX, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT
• DAMAGES RESULTING FROM INTERRUPTION OR CESSATION OF THE SERVICE
• DAMAGES RESULTING FROM ANY CONTENT OR CONDUCT OF THIRD PARTIES

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You agree to defend, indemnify, and hold harmless Confix and its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Content you upload or submit to the Service
• Any activity under your Account

12.1 Termination by You

You may terminate your Account at any time by using the account deletion feature in your settings or by contacting us. Upon termination:

• Your access to the Service will be immediately revoked
• Your data will be deleted in accordance with our Privacy Policy
• Any unused credits will be forfeited
• Paid subscriptions will not be refunded (except within the 7-day guarantee period)

12.2 Termination by Confix

We may suspend or terminate your Account and access to the Service at any time, with or without cause or notice, including but not limited to:

• Violation of these Terms or our policies
• Conduct that may expose us to legal liability
• Extended periods of inactivity
• Requests by law enforcement or government agencies
• Discontinuation of the Service

12.3 Effect of Termination

Upon termination, all rights granted to you under these Terms will immediately cease. Sections that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, limitations of liability, and indemnification.

13.1 Informal Resolution

Before filing a formal dispute, you agree to contact us first at support@confix.dev to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days.

13.2 Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

13.3 Arbitration

Any dispute arising from these Terms that cannot be resolved informally shall be resolved by binding arbitration. The arbitration shall be conducted on an individual basis; class arbitrations and class actions are not permitted.

13.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Confix regarding the Service and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Confix.

14.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or internet service failures.

14.6 Headings

The section headings in these Terms are for convenience only and have no legal or contractual effect.
